These Terms and Conditions (“Terms”) govern all online orders placed with CHICHA San Chen Chino (“Company,” “we,” “our,” or “us”). By placing an order through our website, mobile application, or authorized ordering platform (“Online Ordering Services”), you (“Customer,” “you,” or “your”) agree to be bound by these Terms. Please review them carefully.

1. Order Acceptance and Confirmation

1.1 All online orders are subject to acceptance and availability.

1.2 Once payment is processed and the order is confirmed, the transaction is deemed final and binding.

1.3 We reserve the right to refuse or cancel any order at our sole discretion, including but not limited to suspected fraudulent activity, technical errors, or product unavailability.

2. Payment

2.1 Full payment must be made at the time of placing the order through the available payment methods.

2.2 Prices are displayed in the applicable local currency and may be subject to sales tax or additional charges.

2.3 The Company is not responsible for bank, card issuer, or payment platform fees.

3. Pickup Orders

3.1 All online orders are pickup only at the designated store location specified in the order confirmation.

3.2 Customers must collect their orders within the timeframe indicated. Failure to pick up an order may result in product quality deterioration for which the Company bears no responsibility.

3.3 Orders not collected on the scheduled date will not be refunded.

4. Cancellations, Modifications, and Refunds

4.1 Once an order is placed and preparation has begun, it cannot be canceled or modified.

4.2 Refunds will only be issued if an item is unavailable or if the Company confirms an error in preparation.

4.3 Refunds, where approved, will be processed via the original method of payment within a reasonable timeframe.

5. Risk and Responsibility

5.1 Title and risk of loss or damage pass to the Customer upon pickup of the order.

5.2 The Company is not responsible for dissatisfaction based on personal taste preference, sweetness level, texture, or size once the order has been collected.

6. Disputes

6.1 Any disputes relating to an online order must be reported to the store manager or customer service within 24 hours of pickup.

6.2 The Company reserves the right to investigate claims and determine resolution at its sole discretion.

7. Limitation of Liability

7.1 To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages arising from online ordering.

7.2 The Company’s total liability for any claim shall not exceed the amount paid by the Customer for the specific order in dispute.

8. Governing Law and Jurisdiction

8.1 These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the store is located.

8.2 Any legal proceedings shall be brought exclusively in the competent courts of that jurisdiction.
